The SSA reviews the SSDI and decides whether or not to approve, deny, remand, or request additional information. It then sends a memo to the MDH Unit, indicating whether the data-related agreement is approved, deferred, or remanded. The MDH Unit may execute the agreement if the agreement has been approved.
If an applicant is denied, the SSA sends a second warning. After the date of denial, the applicant has sixty-five calendar days to request an administrative law judge (ALJ) hearing. Similar to hearings regarding disability issues, this hearing is also possible. You can have it in person, via phone, or by videoconference. The hearing may include witnesses from the applicant's or his/her representative who can testify about the issues or the circumstances of the denial. The ALJ might also request expert testimony to support the case. If the applicant loses, the ALJ will notify him or her in writing, describing the reasons for their decision. The hearing could take many months.

A disability review can take between three and seven years. It may be approved, denied, or remanded for additional information. The SSA might also start a disability review if an individual's medical condition has improved and they are able to return work.

A Data-Related Agreement refers to a legal document that needs approval by the SDI Team. These agreements must be submitted via Cognito Forms. They must also include relevant documentation and contracts. The SDI Team has 30 days to review a Data-Related Agreement, and they may ask for more information such as security controls and a SOC 2 Type II audit. They may also request additional information, such as questions related to data migration.
Once a Data-Related Agreement is submitted, the SDI Team will review the documentation and proposed contracts. The Agreement will be subject to the same security and privacy policies as other forms of documentation submitted through Cognito Forms.
